Terms of Service

These Terms apply to SocialArcadeNZ.com (socialarcadenz.com) and any games, content, and services we provide (the “Service”). By using the Service, you agree to these Terms.

1) Eligibility (21+)

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you confirm you meet this requirement.

2) Accounts & conduct

  • Keep your login details secure; you are responsible for activity under your account.
  • Provide accurate information and keep it up to date.
  • Do not share, sell, transfer, or allow others to access your account.

3) Virtual currency & in-game items

  • Any virtual currency, credits, tokens, or items are licensed to you for use in the Service only.
  • They have no cash value, are not legal tender, and are not redeemable or refundable for money (except where required by law).
  • We may change, suspend, or remove virtual currency/items as part of updates, balance changes, or enforcement actions.

4) Prohibited behaviour

  • Cheating, exploiting bugs, automation/bots, reverse engineering, or interfering with the Service.
  • Harassment, hate, threats, unlawful content, or privacy violations.
  • Fraud, chargeback abuse, or attempts to circumvent security or access controls.
  • Uploading malware or attempting to disrupt networks or systems.

5) Intellectual property

The Service (including software, designs, text, graphics, audio, and trademarks) is owned by or licensed to us and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service for lawful personal entertainment in accordance with these Terms.

6) Disclaimers

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation, or that any content, features, or virtual items will always be available.

Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under New Zealand law that cannot be excluded (including the Consumer Guarantees Act 1993 and Fair Trading Act 1986). If you use the Service for business purposes, to the extent permitted by law, you agree we may contract out of the Consumer Guarantees Act 1993.

7) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, consequential, or special loss, loss of profits, loss of data, or loss of goodwill arising from your use of (or inability to use) the Service. Where liability cannot be excluded, it is limited to the minimum amount required by law.

8) Suspension & termination

We may suspend or terminate access to the Service (including accounts and virtual items) if we reasonably believe you breached these Terms, pose a security risk, or where required to comply with law. You may stop using the Service at any time.

9) Disputes & governing law (NZ)

If you have a concern, contact us first and we will try to resolve it promptly. These Terms are governed by the laws of New Zealand, and the parties submit to the non-exclusive jurisdiction of the New Zealand courts.
